| Marketing / Faxing Consent Form On July 3, 2003, the Federal Communications Commission (FCC) issued a Report and Order amending the regulations that implement the federal Telephone Consumer Protection Act. Most of the attention directed to this high-profile rule making was aimed at the do-not-call-list, which generally should not impact tax-exempt nonprofit entities such as trade and professional associations. The FCC also made significant changes to the rules governing unsolicited faxes, which do have a direct and significant impact on nonprofit organizations. The new rules which (became / will become) effective August 25, 2003 will require signed written consent in order for organizations to send faxes which contain unsolicited advertisements - even to association members. (Unsolicited advertisements would include upcoming CPE reminders. Without the signed written consent form in the association's hands, the association would be prohibited from faxing you a CPE registration form, even if you called and requested one.) The consent must include the fax number to which the faxes are to be sent. Once the rules are in effect, sending a fax to seek consent will be forbidden. Due to the FCC's Report and Order, we are requesting, via our website, that members and other interested parties provide their consent to receive faxes from our organization. The consent form covers all forms of communication, just in case the FCC decides to amend its Report and Order to include telephone and email unsolicited material. Please check the appropriate boxes and return the form to the association office as soon as possible. WASHINGTON (8/19/03)--The Federal Communication Commission (FCC) yesterday extended the effective date of its "Do-Not-Call" fax rule from Aug. 25 to Jan. 1, 2005. Read the full FCC release (PDF) Many associations and organizations lobbied FCC officials and members of Congress to reconsider the rule, which requires prior written permission to be obtained before fax communications can be sent to members on commercial matters. It also would require ongoing communications with members in order to send the members faxes. We will keep working to dilute or rescind the FCC's rule.
